With the emergence of European data spaces and data markets, one of the fundamental issues to tackle is building trusted digital relationships between the parties in a data ecosystem.

In this whitepaper, we propose a means to establish trust through transparency and auditability concerning the use of data. We call it the Data Exchange Agreements (DEXA) suite. Having a legal, auditable construct for data transactions benefits not only the individuals whose data is in play but also the organisations involved in the exchange of that data, ensuring that the risk of non-compliance and contentious legal disputes is minimised. In case of a dispute, the agreements can be shared with a third-party auditor or used in a court of law. The DEXA suite facilitates the governance of the ecosystem for actors such as data sources, data using services and data intermediaries.

The paper addresses how organisations can:

1. build trust with individuals by being transparent about their personal data usage, where individuals are empowered to control the use of their data
2. legally capture data beyond what is accessible within their data sources
3. ensure an auditable provenance trail that minimises the risk of non-compliance and data misuse

For application developers, DEXA provides a simplified abstraction well connected to their existing data protection processes (e.g. DPIA) and focus on their core functions, i.e. processing, consuming and exposing data.
